Winning Invalidation Action Against Nichia’s Taiwan Design Patent
Taiwan IP Court rendered a decision on March 03, 2011 holding that the patent in issue is invalid and reversing the original decisions of TIPO and the Petition and Appeal Committee of MOEA..
With respect to the Taiwan patent invalidation action against Nichia Corporation concerning Nichia’s design patent No. 089036, the Taiwan Intellectual Property(IP) Court rendered a decision on March 03, 2011 holding that the patent in issue is invalid and reversing the original decisions of Taiwan Intellectual Property Office(TIPO) and the Petition and Appeal Committee of MOEA. In the judgment received on March 14, 2011, the IP Court stated that TIPO should render a decision revoking Nichia’s patent in issue due to a lack of creativeness. We believe that IP Court’s such decision in administrative procedure, which is consistent with the Court’s former decision in the civil procedure rendered on July 22, 2010, is entirely reasonable.
